3. Booking and Payment

• All bookings must be made through our website or mobile application.

• Payment must be completed before the service is provided.

• We accept payments via credit/debit card, digital wallets, and other approved methods.

• Prices are subject to change without prior notice.

4. Cancellation and Refund Policy

• Customers may cancel bookings within a specified period for a full or partial refund, depending on the service booked.

• No refunds will be issued for last-minute cancellations unless stated otherwise.

• Refunds, if applicable, will be processed within 7-14 business days.

5. User Responsibilities

• You must provide accurate and complete information when using our services.

• Any misuse, fraudulent activity, or violation of our terms will result in account suspension or termination.

• You are responsible for maintaining the confidentiality of your account credentials.

6. Liability Disclaimer

By using the Drivr platform (the "App"), you agree and acknowledge that Tuchware Technologies Pvt. Ltd. ("Drivr") acts solely as a technology aggregator, enabling users to connect with independently contracted drivers (“Service Providers”) for mobility and transportation services. Drivr does not own, operate, employ, or control any driver directly.

6.1. No Responsibility for Driver Conduct

Drivr shall not be liable for the personal conduct, behavior, or actions of any driver, including but not limited to:

• Rash or negligent driving

• Violation of traffic laws or road safety regulations

• Consumption of alcohol or intoxicants before/during service

• Inappropriate behavior, misconduct, or harassment

• Unauthorized use of your vehicle or access to your property

In the event of any such incident, users are strongly advised to report the matter immediately through the in-app complaint system and to the relevant law enforcement authorities.

6.2. Vehicle Usage & Compliance

Users are solely responsible for ensuring that their vehicle is:

• Roadworthy, legally registered, and adequately insured

• Equipped with necessary documents and permits as per the Motor Vehicles Act

• Not used for unlawful or unauthorized activities while being driven by the driver

Drivr will not be liable for any fines, penalties, theft, damages, or misuse arising from the use of your vehicle by the assigned driver.

6.3. Limitation of Liability

To the maximum extent permitted by law, Drivr disclaims all liabilities, whether direct, indirect, incidental, special, or consequential, arising out of or in connection with:

• The use of or inability to use the services

• Delay, cancellation, or modification of bookings

• Accidents, loss of property, personal injury, or death

6.4. Indemnity Clause

You agree to indemnify and hold harmless Drivr, its affiliates, employees, directors, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with:

• Your violation of these Terms

• Any misuse of the services or the platform

• Any third-party claim arising due to your actions or your use of a Service Provider

• We are not liable for any damages, losses, or injuries resulting from the use of our services, except where required by law.

• In case of vehicle rental, the customer assumes full responsibility for any damages beyond normal wear and tear.
